STOPPING A GARNISHMENT THROUGH BANKRUPTCY IN ALABAMA

STOPPING THE GARNISHMENT AND KEEPING YOUR PAYCHECK

If you are currently being garnished, bankruptcy may be your best bet to stop the garnishment while also alleviating some of your other monthly debt payments.  Once your case has been filed with the court, we will notify your creditor and payroll department to get the garnishment to stop.  As long as the debt is one that can be discharged through your bankruptcy, there should be very little time between the filing of your case and your garnishment stopping.

HOW YOUR EMPLOYER IS INVOLVED IN THE GARNISHMENT

If you get garnished your employer’s payroll department will be notified, and they will have the uncomfortable position of being in charge of actually garnishing the paycheck on behalf of the creditor.

TAX LIEN GARNISHMENT

A tax lien is not dischargeable through a chapter 7 bankruptcy.  If a tax lien is something that you need help with, a chapter 13 plan could be filed to ensure that this debt is paid in full.

HOW THE AUTOMATIC STAY AFFECTS THE GARNISHMENT

An automatic stay is the court protection that goes on the debtor(s) in bankruptcy.  This is the protection that actually halts creditor collection actions, with some exceptions, at the time a bankruptcy petition is filed.

CONCERNING MY GARNISHMENT, DOES IT MATTER IF I FILE CHAPTER 7 OR 13?

No, you will receive relief from your garnishment from filing bankruptcy, no matter which chapter it is. If you file a chapter 13, you might pay all or a portion of the debt over the years of your plan.

CHILD SUPPORT GARNISHMENTS

A garnishment for child support or other domestic obligation will not stop automatically when a bankruptcy is filed.  These priority debts are not part of the protective stay.

FINANCIAL BUDGETING MOVING FORWARD

During your bankruptcy, you are required by the court to take two credit counseling/financial management courses.  These will help you learn simple and effective budget techniques you can use to stay on track in the future.

HAVE YOU BEEN SUED?

If you have faced a lawsuit and your paycheck is being garnished it can make an already difficult economic time unbearable.  However, filing bankruptcy can help alleviate the garnishment.  When the bankruptcy is filed an automatic stay goes into effect.  The stay is a protection over you and your assets which halts all creditor action until the case is completed and discharged. In the case of collection actions for unsecured debt, the bankruptcy discharges the debt and you will no longer need to worry about the judgment. Call us today and set an appointment to see how we can help stop your garnishment.
