HOW THE BANKRUPTCY PROCESS WORKS
Declaring either chapter seven or thirteen bankruptcy need not be a complicated process as long as you have a trusted consumer debtors attorney to counsel you. If you retain Mrs. Cain, she will make it as simple as possible to relieve you of medical debt, credit card debt, or figure out what to do with your underwater mortgage in a welcoming environment. Unlike some other attorneys, she will personally meet with you several times to make sure we have all of your paperwork, and she will pull the most current credit report and review the necessary court petition. Mrs. Cain will serve as your dependable Birmingham bankruptcy attorney throughout the entire process; filing the petition on your behalf and then making sure you have your case number and hearing date information. At your 341 meeting she will meet you there personally to represent you, which isn't the case at some larger firms. Mrs. Cain only focuses on consumer bankruptcy protection, which she feels makes her a better advocate for your rights throughout your case.
OUR GOAL IS TO PUT YOUR MIND AT EASE THROUGHOUT THE PROCESS
At Less Stress Birmingham Bankruptcy Attorneys, your bankruptcy lawyer takes a hands on approach to your case. Your competent and honest attorney will be there to guide you along the way to a fresh financial start. You don’t get passed off to a paralegal or another assistant like some other lawyers have been known to do, and your BK attorney is there to personally represent you at your hearing, not some other attorney you haven’t met before. If you have a question or concern along the way, rest assured attorney Melissa Cain will answer the phone and discuss it with you personally. Mrs. Cain will stick with you through your entire chapter 7 bankruptcy or chapter 13 bankruptcy filing.
STOPPING THE HARRASING TELEPHONE CALLS
After you retain Mrs. Cain, you are free to refer your creditors to our office. Although they are not obligated to stop contacting you at this point, it should greatly reduce the amount of creditor contact you receive. Once you file your case and the creditors get your case notice, they will immediately stop contacting you altogether.
YOUR DAY IN COURT
Attending Birmingham bankruptcy court is part of the process, but you will not be alone. Mrs. Cain will meet you there and make sure any of your questions are answered. In most circumstances you will only need to go to court once, and the hearing is very brief. A 341 meeting of creditors is the mandatory court hearing when filing a chapter 7 or chapter 13 case. In a ch. seven, a 341 meeting is scheduled to make sure that all assets and debts were listed and that nothing was left off of your bankruptcy petition. It also allows creditors to come forward with any questions, although this rarely occurs. A ch. 13 341 meeting is focused on the plan payment and creditor claims that have been filed in the case. A confirmation hearing is also scheduled for a chapter 13 bankruptcy case, although the debtor(s) do not need to be present under most circumstances.
BEING SUED BY CREDITORS
Many times when you get lawsuit paperwork, you do not recognize the name of the creditor. If this is the case, a collection agency has bought the original debt and decided to pursue collection through a lawsuit. You should not ignore a notice of a lawsuit, because doing so will open you up to possible garnishment of paychecks or levying of your bank account. Filing a chapter 7 bankruptcy or a chapter 13 bankruptcy will eliminate most debts and immediately stop a garnishment under most circumstances. Please contact our attorney immediately for a consultation in order to avoid a costly mistake. We are available at 205-582-7007.
FACTS ABOUT CREDIT COUNSELING
Credit counseling is a mandatory certificate you must get prior to filing your chapter 13 bankruptcy or chapter 7 bankruptcy case. The certificate must be through an authorized provider for your jurisdiction and must not be older than 180 days. You can think of the certificate as an additional step in making sure BK is the correct step for you.
Whether you file a chapter 7 bankruptcy or go into a debt consolidation plan with chapter 13 bankruptcy, our office will analyze your situation and give you a thorough explanation of every option available. Although some may claim that filing a chapter 7 or 13 bankruptcy boils down to paperwork being filled out by the client, this actually couldn't be further from the truth. The many variables in each case cannot be overlooked, and doing so could risk further financial suffering. Picking out the right Birmingham bankruptcy lawyer is imperative. I urge you to take your time and find a bankruptcy attorney that you can trust, is experienced in both chapter 7 bankruptcy as well as chapter 13 bankruptcy, and will be there to walk you through this difficult time. You can meet with our office free of charge. Just fill out the form above to get started. You will be contacted shortly by an attorney you can trust!
